Construction of the Contract

1. These conditions shall apply to all Contracts between Meantrade and the parent company (hereinafter referred to as "the Company") and any persons, firm or Company (hereinafter called "the Customer") for the supply of goods or the carrying out of work by the Company. The Company Contracts upon the terms of these Conditions only, and any other standard Terms emanating from the Customer shall not apply. These Conditions shall not be modified without the written Agreement of the Company, and in order that the Contract shall be complete of the Agreement between parties with regard to the supply of goods or the carrying out of the work by the Company, the Customer must ensure that any representation or instruction on which It wishes to rely has been accepted by the Company in writing.

2. A contract is formed with a customer when we confirm in writing that your order has been accepted. Orders will not be accepted until we receive authorisation of your credit card payment or your cheque has been cleared. We reserve the right not to accept orders from you if your address is outside the United Kingdom.

3. Any typographical, clerical or other error or omission in any of the company's catalogues, advertisements, website, quotation, price list, acceptance of offer, invoice or other document or information issued by the company ("sales literature") may be corrected without any liability on our part.

4. No drawings, illustrations or descriptions or any other information submitted or contained in sales literature shall be deemed to form part of the contract but are for general information and guidance only.

5. The contents of this website are copyright of Meantrade and the Parent Company. Trademarks upon the Website are either owned by, or licensed to Meantrade and the Parent Company. Nothing in these terms and conditions transfers the customer any rights of ownership of such trademarks, or constitutes a licence to use such trademarks.

6. The copying or incorporation into any other work of part or all of the material available on this website in any form is prohibited save that the customer may:
6.1. print or download extracts of the materials on this site for personal use; or
6.2. copy the materials on this site for the purpose of sending to individual third parties for their personal information, provided that you acknowledge Meantrade and the Parent Company as the source of the material and that the customer informs the third party that these conditions apply to them and that they must comply with them.

Information Provided

7. Information on this Website is provided "as is" without warranty of any kind, either express or implied including, but not limited to, the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement.

8. Information on this website may be incomplete, out of date or inaccurate and may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. It is therefore essential that the customer verifies all information before taking any action in reliance upon it.

Limitation of Liability

9. In no event will Meantrade and the Parent Company be liable to any party for any direct, indirect, special or other consequential damages for any use of this Website or on any other hyper-linked website including, without limitation, any lost profits, business interruption, loss of programs or other data on the customer's information handling system or otherwise, even if Meantrade and the Parent Company is expressly advised of the possibility of such damages.

10. Meantrade and the Parent Company provides the services "as is" and "as available" and without any warranty or condition, express or implied. Without prejudice to the generality of the foregoing, Meantrade and the Parent Company does not warrant that the website will operate without interruptions, be timely, secure or error-free and shall not be liable for any loss or damage arising from the unavailability of the Website from time to time or from the customer's inability to use the Website.

Online Payment

11. Meantrade and the Parent Company shall use its reasonable endeavours to ensure that the customers credit card information is encrypted to a degree which is even more secure than the level of encryption specified for the SET (Standard Electronic Transaction) protocol and which is more secure than standard browser SSL security. However, the security of any such information cannot be guaranteed and, save where losses are directly attributable to the act or default of Meantrade and the Parent Company, Meantrade and the Parent Company shall not be liable for any losses suffered by the customer in consequence transmitting such information electronically through this site.

Paying

12. The customer can pay either by Visa, MasterCard, Switch or Delta. The customer may send their credit or debit card information over the Internet, or via the telephone. If payments are taken by telephone, details are shredded after entered on the company's payment system. The company will make use of secure links to handle payment details and the customer can therefore shop with complete confidence.

13. Our privacy policy is outlined in detail on our Website. If customers have any hesitations about using their credit card over the Internet please telephone the company on 0845 370 8868 where orders can be taken manually.

14. To avoid any confusion all prices that appear in our catalogue and on our Website are expressed in £'s sterling and exclude VAT.

Delivery

15. Most of the orders that are placed will be satisfied from the stock in the warehouse and therefore once we have received your order we will endeavour to deliver your goods within 2-5 working days.

16. There may be occasions when we are waiting for shipments to arrive from our manufacturers when the delivery time may be a little longer. If the product you want to order is out of stock we can hold your order on file until stock becomes available.

17. All orders under £100.00 will incur a delivery charge of £6.95. Orders of £100.00 and over will be delivered to the customer free of charge. All orders will be delivered via a courier despatch company and will require a signature.

18. Unfortunately these delivery terms only apply to goods delivered to UK mainland locations.

19. We regret that we cannot despatch any order unless payment has been approved.

Refunds and Returns

20. If you wish to return any product to Meantrade, for whatever reason, you MUST first obtain a Returns Authorisation Number from our Customer Service team on 01507 328031. Customers must quote this number on the outside of the packaging when returning the product(s). The company will not accept any returns without an RA number.

21. Products damaged or missing in delivery:
Please check the contents of any delivery against your delivery note or invoice. If anything is damaged or missing, please call our Customer Service Team WITHIN 24 HOURS on 0845 370 8868. Meantrade will ask customers to post back the damaged lamps (or a sample if a large order) in exchange for two additional bulbs to cover the cost of packaging. Replacement items will be despatched from stock (subject to availability), following receipt and inspection. ANY item returned to Meantrade must have an RA number (see above). Please include a description of the problem and a copy of the original invoice with your returned items.

22. Replacements:
If any Item is found to be defective it should be returned to Meantrade at the customer's expense, suitably packaged to avoid transit damage - preferably in its original packaging. Please include a description of the problem and a copy of the original invoice with your returned items. Following inspection, Meantrade will replace faulty items at its discretion.

23. If a refund is appropriate, Meantrade will refund money using the same method as it was originally paid (e.g. a purchase made using Visa will be refunded to your Visa account).
23.1. Refund on unsuitable goods:
Meantrade will provide a refund on goods that you find are not suitable for their intended purpose. Refunds will be made, using the same method as original payment, minus the shipping & handling costs. All goods must be returned within seven days of receipt, in new condition, complete with original packaging and all accessories and utilities. If the customer is unsure about product suitability, please discuss the application before purchasing, this will help avoid disappointment.
23.2. If for whatever reason the customer is not happy with the products purchased, the customer may return the products back to the company providing it is within seven days of receipt and returned in their original condition and packaging. Unfortunately in these circumstances the customer will have to meet the cost of returning the goods by a suitable parcel carrier.

24. Please note that the life rating of the lamps is indicative and is not a guarantee.

Descriptions

25. While every care is taken to ensure that the information contained on our website and literature is accurate and reliable circumstances can and do change. Dimensions, finishes and wattages are only given as a guide to assist customers and do not constitute a legally binding contract. We reserve the right to alter product specification without notice.

Online Security

26. At Meantrade we take online security very seriously. Full details of how we protect the information you provide us with are given below.

27. When customers place their order, a padlock symbol should appear in the bottom corner of the internet browser window. The secure server software encrypts all information, including credit card numbers, passed between the customer's browser and the server.

28. To check the security of the company's website, customers can simply look in the lower bar of their browser when filling in payment details. This will show an unbroken key or closed lock, showing that encryption is active and the customer's information is secure. For security reasons, the company strongly recommends that customers do not send credit card numbers by standard email but use the secure facility provided on this website. Availability

29. The company reserves the right to withdraw their acceptance of the customers order if any goods are not readily available and to refund in full any payment the customer has made. Other goods ordered by the customer will be despatched in the normal way.

Tax

30. The price of the goods is exclusive of value added tax. The packing, postage and carriage cost will be displayed on www.meantrade.com and confirmed to the customer at the time of ordering. All payments must be in pounds sterling.

Property and Risk

31. Risk of damage to, or loss of, goods shall pass to the customer at the time the goods leave the company's premises for delivery including where the company arrange for delivery.

32. Until the customer has paid in full for the supply of goods and the carrying out of work under the Contract.

Disclaimers

33. The company shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our instruction (whether oral or in writing), misuse or alteration or repair of the goods without the companies approval.

34. We shall not be liable for situations of force majeure where any failure in the performance of any of our obligations is caused by factors outside our control:
a) Act of God, explosion, flood, tempest, fire or accident;
b) War, threat of war, sabotage, insurrection, civil disturbance or requisition;
c) Acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
d) Import or export regulations or embargoes;
e) Strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of the company or of a third party);
f) Difficulty in obtaining materials, labour or machinery; and
g) Power failure or breakdown in machinery.

Variation

35. The company reserves the right to vary these terms and conditions at any time but the terms and conditions, which apply to the contract between the company and the customer, shall be those in force at the time we accept the customers order.
